THE PLANNING ACT 2008, THE INFRASTRUCTURE PLANNING (APPLICATIONS: PRESCRIBED FORMS AND PROCEDURE) REGULATIONS 2009 & THE INFRASTRUCTURE PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) REGULATIONS 2017
On 16 August 2021, The Planning Inspectorate (PINS) on behalf of the Secretary of State, accepted an application (the 'Application') by Net Zero Teesside Power Limited and Net Zero North Sea Storage Limited (the 'Applicants') whose registered offices are both Chertsey Road, Sunbury on Thames, Middlesex, TW16 7BP for a Development Consent Order under The Planning Act 2008 for the Net Zero Teesside Project (the 'Project'). The Application (Application Reference: EN010103) is currently in the pre-examination period prior to being examined by a panel of Examining Inspectors appointed by PINS (the 'Examining Authority'). The Project will be the UK's first commercial scale, full chain Carbon Capture, Usage, and Storage (CCUS) project and will initially capture up to 4 million tonnes (Mt) of carbon dioxide (C02) emissions per annum. The main elements of the Project include a new gas-fired electricity generating station with post-combustion carbon capture plant; gas, water and electricity connections (for the generating station); a C02 pipeline network (a 'gathering network') for collecting C02 from a cluster of local industries on Teesside; a C02 compressor station (for the compression of the C02) and a C02 export pipeline. The C02 captured from the electricity generating station and local industries will be compressed and then transported (via the export pipeline) for secure storage within the Endurance saline aquifer located 145 kilometres offshore from Teesside under the North Sea.
The Project involves land at and in the vicinity of the former Redcar Steel Works site, Redcar and in Stockton-on-Tees, on Teesside (the 'Site'). The former Steel Works site, along with other land required for the Proposed Development, lies within the boundary of the land controlled by the South Tees Development Corporation, which is now known as Teesworks.
The Net Zero Teesside Project is an Environmental Impact Assessment (EIA) development, as defined by The Infrastructure Planning (Environmental Impact Assessment) Regulations 2017.

Since submission of the Application, the Applicants have continued to engage with Interested Parties with a view to addressing their comments and agreeing common ground, while also continuing with detailed project development. This has included progressing further work on the optionality around certain elements of the Project. This work has identified a number of changes that the Applicant is now seeking to make to the Project. The changes relate primarily to the optionality included in the Application (particularly around the connection corridors for the Project) and a reduction in land take (or a reduction in the powers sought over land). In addition, there are other minor changes or updates to the Project. The Applicants therefore intend to request a change to the Application. In advance of seeking approval from the Examining Authority to change the Application, the Applicants are carrying out non-statutory consultation on the proposed changes. A consultation document, which includes environmental information, has been prepared, which explains the changes that are being proposed. The proposed changes are summarised below with reference to the relevant Works Numbers (Nos.) set out at Schedule 1 of the draft DCO and shown on the Works Plans: Proposed changes

Removal of optionality for the Gas Connection by removal of both 'new build' options - Option 1A and Option 1B (i.e. removal of the long tunnel between North Tees and the Power Capture and Compression (PCC) site) resulting in a reduction in the Order Limits. There will also be a reduction in land take elsewhere following pre-Front End Engineering Design (pre-FEED) and landowner consultation for the selected Gas Connection -Option 2 (Sembcorp Pipeline Tie-in). Reduction in optionality for the Gas Connection has resulted in the removal of the Above Ground Installation required for Option 1B (Trafigura tie-in and new underground pipeline). This results in a reduction in the Order Limits. (Work No. 2B)_
